3. Project Development
The client is responsible for providing all necessary information, images, documents, branding materials, and content required for the development of the website.
Delivery times may vary depending on:
- Project complexity
- Client response times
- Requested revisions
- Availability of required materials
4. Revisions and Additional Work
The project includes the revisions specified in the accepted proposal.
Any additional features, modifications, or changes requested after approval may be subject to additional charges.
5. Website Maintenance
Clients subscribed to a monthly maintenance plan are responsible for making payments on time.
A 15-day grace period will be granted after the payment due date.
If payment is not received within this period, Eminencia Web reserves the right to temporarily suspend the website and any associated services until the outstanding balance has been paid.
Suspension of the service does not imply deletion of the website or termination of the agreement.
6. Payments
All services must be paid according to the quotation or agreement accepted by the client.
Once a project begins, development resources, working hours, and technical planning are exclusively allocated to that project.
7. Cancellation and Refund Policy
All payments are final. No refunds will be issued.
Once a project has been started or any service has been contracted, payments made are considered non-refundable, regardless of the project's stage of completion or the client's decision to discontinue the project.
By purchasing our services, the client acknowledges and accepts this refund policy.
8. Intellectual Property
All source code, designs, graphics, documentation, and other materials created by Eminencia Web remain the intellectual property of their respective creators until the project has been paid in full.
Upon full payment, the client receives the rights to use the website according to the agreed scope of the service.
9. Service Availability
While we strive to provide reliable and uninterrupted services, Eminencia Web cannot guarantee continuous availability due to circumstances beyond our control, including but not limited to:
- Hosting provider issues
- Domain registrar services
- Third-party platform outages
- Cybersecurity incidents
- Internet service interruptions
- Scheduled maintenance
- Power outages
10. Search Engine Optimization (SEO)
Our websites are developed following SEO best practices to improve visibility in search engines.
However, Eminencia Web does not guarantee specific rankings or positions on Google or any other search engine, as rankings depend on constantly changing algorithms and external factors beyond our control.
11. Confidentiality
We are committed to protecting our clients' privacy.
All information, documents, credentials, and business data provided to Eminencia Web will be treated with strict confidentiality and will not be disclosed to third parties without the client's authorization, unless required by law.
12. Limitation of Liability
Eminencia Web shall only be responsible for the services expressly contracted by the client.
We shall not be liable for indirect damages, loss of profits, business interruptions, or any losses arising from third-party services or circumstances beyond our control.
13. Changes to These Terms
Eminencia Web reserves the right to modify these Terms and Conditions at any time.
Any updates will become effective immediately upon publication on our website.
14. Governing Law
These Terms and Conditions shall be governed by the applicable laws of the jurisdiction in which Eminencia Web operates.
Any disputes arising from these Terms shall be submitted to the competent courts of the applicable jurisdiction.
